Silent Torture: Trafficking Through Guardianship [Video]

Elder Dignity & Power Living Media Release Video Linking Human Trafficking and Guardianship

Features Top Elder Justice Advocates and Families Affected

What would you do if a loved one was forced into isolation simply so his or her money could be stolen? Seniors and dependent adults are being forced into isolation, often sedated at home or in locked care facilities, while their assets are spent down. It sounds like Nazi Germany but it's happening right now in America. It is Silent Torture: Trafficking Through Guardianship.

The victim is silenced through isolation and medication. The family (or defender) is silenced through defamation and sanctions. The act itself is kept silent through closed hearings and sealed records. The forced isolation that often is used in guardianship meets the three constituent elements of human trafficking according to the definition put forth by the United Nations Office on Drugs and Crime.

a) The Act (What is done) -- recruitment, transportation, transfer, harbouring or receipt of persons, b) The Means (How it is done) – coercion, abduction, deception, fraud, abuse of power, a position of vulnerability, OR the giving or receiving of payments or benefits to achieve the consent of a person having control over another person. c) The Purpose (Why it is done) – exploitation. In this case, financial exploitation -- a form of servitude.

Like sex trafficking victims, these victims are psychologically coerced through acts like isolation and the use of drugs. Instead of illicit drugs, psychotropic drugs are administered by nurses and hidden through HIPPA laws.

It's all about the money - with $273 billion under guardianship and $68 trillion to be transferred from Baby Boomers over the next  years, there's a lot at stake and a "new mafia" has formed to control the till. These crimes are facilitated through the equity court which has no jury, no rules of evidence and no due process. The judge is all powerful and the attorneys can lie without reprimand.

The video features the top elder justice advocates in the country, such as Terri and Rick Black, Founders of the Center for Estate Administration Reform (CEAR); Dr. Sam Sugar, Founder of Americans Against Abusive Probate Guardianship (AAAPG); Philip C. Marshall, Founder of Beyond Brooke; Thomas Wright, Producer of Edith + Eddie; Dr. Zena Crenshaw-Logal, Founder of National Judicial Conduct & Disability Law Project; among others. It also includes families of victims in Florida, Nevada, California, Michigan, Minnesota, New Jersey and Virginia, showing the similar pattern and practice that happens across the country.

The Dr. Lillie Sykes White abduction is used as a case study in the video demonstrating how calculated and cruel the crime can be. She has been entrapped in an involuntary guardianship for eight years and in forced isolation from her chosen loved ones for 1261 days, almost four years. There was no legitimate reason for her abduction in 2016 and no reason for her continued isolation. It is all simply to facilitate constructive fraud so that her $4 million estate can be spent down by an estranged granddaughter and team of attorneys. Even though it is considered one of the most egregious cases in the country, Florida leadership to-date has turned a blind eye.

At the end of the video, there is a direct appeal to President Trump and the 2020 candidates to address the overall issue of forced isolation and the equity court crisis at the federal level. There is also a call to action asking the public to sign a petition requesting that Governor Ron DeSantis free Dr. White. The governor has the responsibility to enforce state laws including Chapter 825: Abuse, Neglect, and Exploitation of Elderly Persons and Disabled Adults. The petition can be signed here:
